Selling posters you don't actually own

I recently found a Mars Attacks! poster I'd never seen before on ebay.com. It was from a French seller who (in my opinion) gives their posters huge prices, this one priced at $389.

I was disappointed because I could neither afford or justify the price. I decided to have a look on ebay.fr and to my surprise, found another copy with a buy it now price of €15. Obviously I clicked the button. Having not seen this poster before I decided to do some research between the 2 listings because I thought it was strange they'd both appear at the same time.

Turns out the .com seller was using the .fr sellers pic, but just corrected the perspective and cropped it slightly. I contacted the .fr seller a few days later and he said the poster 'may' have been sold, then the listing was removed.

I can't work out if he's a scam artist or a genius!?!

If it is him I do know he has a partner but unsure of his partner’s name.

A well-known, expensive dealer does this by using "Special Order" terminology, which many find is wrong...we all know who he is.
