Title: A brief but venomous message from Tloce. [He wants to sue me now]

So, after almost two months of waiting, I got tired of eBay telling me I had to leave feedback for Thomas Loce. As many of you already know, the poster was a pathetic reprint - like, a really pathetic one - Mel did an authentication here: http://www.allposterforum.com/index.php/topic,1977.0.html (http://www.allposterforum.com/index.php/topic,1977.0.html)

I never left him feedback because he was at least courteous, but it always bothered me that somebody so infamous could have such strong positive feedback. So I locked my doors, drew the shades, and left him negative feedback. Not wanting to be called out for libel, I was as objective and honest as I could be.

This was only about an hour ago. Just a few minutes ago, I received a message in my inbox. He was clearly very displeased by the negative feedback.

To anybody who doesn't recall, he claimed when the poster first arrived to me that accidentally harboring reprints is an unavoidable aspect of selling movie posters implying that not only was it not his fault he was selling me an obvious fake but that I should come to expect it for the rest of my collecting career. He then proposed that he give me a refund right away because he is apparently aware of his own reputation.

I still think everybody on this forum should buy one poster from him and leave him negative feedback, but that's just the Italian in me. I just wanted to share my experience and hopefully others will refrain from doing business with him in the future.

I think this statement is exactly why he now has the upper hand...Anthony you have no real proof many of his posters are shameless fakes,,only the one you bought..i hope you get a nice prison wife mate x

He sold several of those Inception posters - so that's plural.  As an experienced dealer, he knew those were fake as hell.  So what you said is absolutely true.

It's all saber-rattling, of course.  He has no intention of suing, just trying to intimidate you.

I'd represent you myself for free if I could, if he were actually to sue.  Unfortunately, Uncle Sam won't let me - total ban on outside representation.

If he really pursues this, ask eBay if you can modify your feedback to state that the poster you bought was fake.  Then you wouldn't be exaggerating.

One thing you could do to maintain your stance could be to adjust your negative feedback to neutral..you could leave a feedback as such....Poster received turned out to be Repro,Seller provided prompt full refund,many thanks.

Out of curiosity, what would be the cost of a lawsuit (if you live in different states) and what damages could he hope to collect?

It would be a really interesting trial. Maybe you could call some expert witnesses to comment on fake posters?

There. I modified the feedback to something less all-encompassing. We'll see if he is pleased - I did my damage with the negative feedback, I don't much care anymore what it says specifically if he's going to threaten to have me deported.

Leave the (amended) negative and do not retract it.  Do not send the poster back.  He had already agreed to letting you keep it (unless you want to return it so he can use it to clean up his spilt milk!?)

Don't worry. I told him flat out I wasn't changing my feedback any further. I then sent him a message saying if he wishes to avoid future confrontations like myself he should inspect his posters more carefully before he advertises them as originals. Even though I had to alter the wording of my feedback, it is still very satisfying to continually call him out in our ongoing correspondence. I'll be sure to post those excerpts in the next couple of hours. I told him  I don't have the poster anymore, I sent it to have it authenticated by an experienced collector.

I wonder if Mel still has it. :P

Does anyone here have any contacts at WB's art department?  If so maybe we can hook Anthony up and offer to send his 1-sheet there for authentication... that will surely get the bottom of things and determine whether or not his feedback is genuine.  

If so, Anthony, you should tell dickhead that you will be happy to return his poster, right after it has been sent to WB for authentication!

This has been attempted (or at least suggested) before but maybe not specifically for Loce.  The consensus was eBay does not give two shits.  Same goes for all the other fakes listed (i.e. watches, electronics, movies etc etc).

eBay will not do anything because they make $$$ from every sale and now even for shipping costs  eyeroll

Go back and look at the original refund email you received from him.  I believe he told you a return is not necessary if it is "not feasible."

Just send him an email quoting his original email and that a return was optional.

Don't respond to any further emails. You're letting him intimidate you. You left truthful feedback and he had the chance to respond to it.  End of story.

That will be very hard to prove with old posters.  That is why I suggested using only the poster you bought and send it to the source (WB) while there are still people there who worked on the poster's creation/printing.  If you try to make a case using something like Scarface, dickhead will just argue that there is uncertainty regarding the printing, but no concrete proof that it is fake.

I agree with Mel ... Just ignore him and leave things as they are .. the threat of a law suit is absurd .. the costs of him hiring a lawyer and filing are way higher than the possible damages he could hope to gain from a frivolous law suit .. Dont let him get to you .. Hes not really going to do anything about the feedback, because it is true.

I think I remember the tow company suit as well .. I dont believe there were no damages awarded, were there? The blogger just had to remove his post, right?

So in a far away land of lunacy where Tloc actually sued the worst case scenario here would be that he sues and spends money on lawyers and all that fun stuff just to have the feedback changed to a neutral ..

Well, that is what he threatened to sue me for. And honestly, I think this is as big of a joke as he does. I altered his feedback at his request that omits the word "many". However, he is selling several fake posters as we speak. I wish there was something more that I could do.

I imagine he has bullied many people into leaving positive feedback. I am proud to be someone who didn't entirely give in to his demands. I don't consider a rewording that is less generalizing a loss, so I doubt he sees himself as victorious right now.

And really, as long as he's unhappy, I'm satisfied. I know I am part of the 1% who left him a negative feedback comment.

The guy is a CROOK!!!  Everybody in the poster community knows it, and I now understand why he doesn't have negative feedback.  By being nice and courteous, by authorizing buyers to return posters and reimbursing them all the costs, including shipping, he guarantees himself positive feedback.  And if by accident, one of those buyers leaves him negs, he scares them and threatens to sue them.  What a great business plan!  Meanwhile, he keeps selling his reprints and reimbursing people as he goes along.  Out of 100 reprints sold, 80 will probably go thru (people being unaware that they bought a fake) and 20 will be in contention.  So Loce will do his little game and win.  

Anthony, your initial negs were great.  I'm surprised you changed them.  The guy has no grounds whatsoever.  I'm really disgusted by his antics.

The further I get from it, the more I wish I'd left it. I would have but it was Stew's comment about how I can't speak for any product besides the one I bought that made me nervous. I wanted my feedback to be an honest reflection of the transaction, but I only bought one poster.

I'd do it differently if I could start over.

I think the change you made in your feedback comment is fine.  You're only referring to your poster rather than making a sweeping comment about everything he sells.

How is people being sued for libel for comments they made on eBay (and other online resources) not relevant?

So you are saying that he should give in and give Tloc good feedback so that he will stop bullying/threatening law suits and just allow Tloc get away with misrepresenting his product as originals and allow him to continue selling fakes and taking advantage of others that just just dont know any better?

Well from the threats TLoc is making the only way to "work it out" would be for him to tuck his tail and change his feed back to a glowing review of Tlocs benevolent customer service ... There is no way to work things out with someone like Tloc this is how he does business and will continue to do so until enough people stand up to the threats and leave him the appropriate feedback .. then new buyers will start to see the truth behind who they are doing business with.

Perhaps since it was impossible for me to change my feedback any further he gave up. He is stuck with negative feedback forever. Maybe he has decided to drop the charges. I think I will write him a sincere letter of gratitude for having mercy on a confused buyer who just didn't know any better. I fell victim to the lies all around me! God have mercy!

Anthony-- Kudos to you for keeping the negative mark on his once untarnished record!    clap  clap  It never made sense how this guy continuously maintained his 100% positive feedback. Your case certainly shed light on it-- with other naive buyers unaware that they had bought fakes (again, basing their choice to buy on his stellar feedback).

I think you were right to amend your wording to speak about your poster alone, since that is what feedback is about-- one's individual dealings with a seller. Even if tloc sells 10 authentic posters out of 1000, your initial, blanket statement would still be untrue. That being said-- you did great!

The idea for others to buy his fakes and then leave neg feedback sounds brilliant, too Let the buying begin!

nice i am glad to see someone take him down a notch (in the eyes of the uneducated buyer). like everyone else says i would also suggest DO NOT TO RETURN THAT POSTER, it is your only evidence he sold you a fake.

this guy is the biggest joke. i almost bought over $1000 dollars worth of posters from him including several of those minty whites when i first started collecting. i was gonna complete the transaction off of ebay too, so no way to leave feedback. thankfully i read around about his reputation because i thought it was kinda weird he was offering such good "deals".

it was so great to look up one of his items and see the 99.9% rating (even though he doesnt deserve that good of feedback either). we all should buy fakes and leave REAL feedback.

I hear you man, really. This thread has developed more into cracking jokes and idle villainous plotting. The matter is long over and dealt with. Lol he wasnt mad....unfortunately. That would have made it forum worthy. He wanted me to buy something. I asked for actual pictures of it. He was insisting I should just buy it and now he would include a free bootleg version. (Wanted ten for the bootleg originally)
I made the point to him that it would be much easier to send a couple photosto me  then to go through the hassle of sending me the posters. But he would rather just send them and pay for return shipping if I wasnt satisfied. Sounds strange to me because all he needed to do was snap a couple pictures. He is probably counting on me not knowing an original from a bootleg and/or me never following up to send them back. Of course he goes off when someone tries to tell him he isnt selling a legit poster. So I dont buy it if I cant see it. I was figuring he'd send me pics of a bootleg anyways. He was stuck on how the coloring would be correct on his original rather than the cropping which is more important. It is possible he has two different quality bootlegs and thats why he was assuring me the color was good.
